A question about the public domain status of a press/publicity photo produced between 1923 and 1977.

Below are some examples of PD-US-no notice licensed drawings. (For the sake of simplicity, we will only consider images made clearly in the US between 1923 and 1977.)

I asked for comments on the following questions:

1) Are the press publications/photographs like the above examples considered "published" as they are? In other words, is it just the act of producing and distributing photos they deem "publishing" them? Or is it necessary to find an image that is then printed in a book, newspaper or magazine?

2) If we assume that such photo producers a) have no intention of releasing their copyright on it, and b) take no action to renew copyright within the prescribed time, can we still regard it as a public domain because it does not have a copyright notice clear?

I received a message about one of the photos I uploaded. I am very careful about photo copyright. To be fair, I uploaded this photo because it does not have a copyright notice, and I strongly believe it is used in other newspapers and magazines. I am inspired by users. We look forward to researching and happily uploading every photo, belonging to the network. Read directly from U.S. Copyright Act (Section 101 Definitions) we found:

"Publication" means the distribution of copies or fonorecords of works made public by sale or transfer of other ownership, or by rent, lease, or loan. Offerings to distribute copies or phonorecords to a group of people for further distribution, public performance or public display are publications. The public performance or appearance of a work is not by itself a publication.

This is quite clear and defines ALL such press images and publicity as "publications". The Centpacrr argument that one copy can be rented to a newspaper for a single printing is still in fact "for further distribution purposes,... or public display" and "is a publication".

Until a few minutes ago, this template and partner in commons had the last sentence identical but the "this page" link went to a different place. Which links should we use? (Also ask in commons) --Jeremyb (talk) 04:43, October 23, 2013 (UTC)
