A leave ( LOA ) is the time period in which a person should be away from one's main job while maintaining the employee's status. This term may be used more limited to exclude other periods away from the workplace (eg, holidays, paid leave, holidays, hiatuses, leave, work from the original program), with LOA used for exceptional circumstances; in general, such arrangements have termination determined on a specific date or after a particular event occurs.

Classification

Generally, paid leave is granted at the request of the employer, or in accordance with the requirements of the law or contract. Some examples of LOAs that are generally paid include employee injury to employment, death, jury duties, or if the employer is performing repairs or other activities within the premises in which employees normally work that prevent them from performing their duties.

Unpaid leave

LOA Unlimited generally at the request of employees or as a result of alleged violations on the part of employees. Missing leave can be obtained for various reasons requested by the employee, including active duty calls for backup military personnel, or to meet the health needs of the employee or family member of the employee.

In many jurisdictions, it is up to the employer's discretion, whether the employee's request for leave is not approved or not. In the United States, the Family and Medical Leave Act of 1993 defines the particular circumstances under which leave approval is mandatory. In addition, the Employment Law and Uniform Services Uniform Rights (USERRA) dictate certain circumstances in which the LOA should be granted.

During periods where employer markets are flagging, some companies offer certain employee classes the opportunity to take unpaid leave as additional vacation time, in an effort to reduce temporary operational costs without the complications of layoffs, and potentially permanently lose critical employees. Such periods are referred to as absence leave in lieu of dismissal .

In the academic world, "unpaid leave" has no negative connotations. This is used to give an opportunity to a professor or staff member to take a non-contradictory position (eg, political position) without losing the original affiliation.

Continued benefits

Generally, the continuation of certain benefits, such as health insurance, is maintained. Other benefits such as Life Insurance usually require employees to pay premiums to be continued during the LOA.

For benefits based on the employee's time in his/her work, the period of absence may be included in the consecutive accounting of the service for certain benefits. If time is not included, it is simply omitted from the count, but is not considered a break in the service.

Type of leave worldwide

Type of leave in India

In India, Government service holders under the Government Union or Provincial Government (State) may utilize the following types of leave during the service period:

  • Earnings: Absenteeism is earned by the employee on a service-term basis but is usually credited to a leave account in two installments per year at a rate of 2.5 days per month (30 days per year). Leaves, if not available, may be collected for up to 300 days, but not more and also permanent employees are entitled to cash equivalent to 80 days of leaves that are not used on the day of retirement from the service.
  • Half-Pay Leave: All government employees are entitled to 20 HPL days for each completed year of service with all leave leaves included in the year. These leaves will accumulate, if not available indefinitely and are credited in advance in two installments per year. They are the basic calculations of commutation leave available to employees after completing one year of service.
  • Committed Leave: Two and a half salary maturities can be converted into one paid full leave. Applied for leave no more than half the amount of half-pay leave because it can be taken at anytime at a certified medical facility. While 90 days of relieved leave can be availed during the entire service period without a certified medical venue.
  • Leave Not on: This leave can not be disbursed by the employee in the same manner as a lightened but previously in good leave on the dismissing authority that the employee must pay off the debt by accumulating half of the paid leave during the subsequent years until his retirement. Such leave is limited to a maximum of 180 days stretching and 360 days throughout the service period.
  • Parental Leave (Maternity Leave, Fathers Leave)
  • Study Leave: A maximum of 03 years is available after the completion of at least 5 years of service.
  • Extra Ordinary Leave: Leave when there is no salary given to the employee because he or she will not attend. This leave is provided to arrange an unexplained absence that causes the termination of service or may be elected by the employee when he or she needs a break and takes time off from the assignment.
  • Casual Leave: This leave is not a leave of absence because employees are deemed responsible and responsible.
  • Child Care Leaves
  • Hospital Leaving
  • Departure of Department of Vacation Officers: Employees who work in departments where annual seasonal vacations are acceptable can not obtain time off. Other leaves apply.
